These Terms of Service (“Terms”) govern your access to and use of Evalpals's website and services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Evalpals website or services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
2. Description of Services
Evalpals operates a managed marketplace that connects attorneys with independent, California-licensed clinical social workers (LCSWs) for psychological evaluation services. Attorneys submit evaluation requests, which are made available to eligible, credential-verified LCSWs who may claim them; if no eligible LCSW claims a request within our service window, Evalpals assigns one. Our services include facilitating requests, verifying and managing providers, coordinating quality assurance, processing payments, and providing a platform for secure document delivery. Evalpals coordinates clinical evaluations and does not provide legal advice or clinical services.
3. User Eligibility
Our attorney-facing services are intended for licensed attorneys and legal professionals. By using them, you represent that you are a licensed attorney or authorized to act on behalf of a law firm. Clinician-facing services are intended for actively licensed California LCSWs who have completed Evalpals' verification and onboarding. All users represent that they have the authority to enter into these Terms.
4. Account Registration
When our platform launches, you may need to create an account to access our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Payment Terms
Fees for evaluation services are as stated on our website at the time of your request. Payment is due at the time of service request unless otherwise agreed in writing.
- All fees are in US dollars
- The standard evaluation fee is $1,500 and is charged when you submit a request
- Your payment is held by Evalpals and released to the assigned clinician after you accept the completed evaluation (or after an automatic acceptance window). These are platform-held funds and are not held in an escrow account
- Refunds depend on the stage of your request: a full refund before a clinician claims it; a partial refund if you cancel after a clinician has begun work but before delivery; and no refund after a completed evaluation is delivered and accepted, except where a quality dispute is resolved in your favor
- The first revision is included; additional revisions may incur a fee as stated at the time of the request
- Testimony and court appearances are not included and are scoped and billed separately
- Volume or firm pricing may be available upon request
6. Evaluation Services
Regarding the psychological evaluation services provided through our platform:
- Evaluations are conducted by independent, licensed LCSWs
- Evalpals facilitates the connection but does not provide clinical services or legal advice
- LCSWs maintain professional independence in their clinical judgments
- Evaluation reports are the professional work product of the evaluating LCSW
- Requests are assigned through a claim-based process; once a clinician is assigned, you can view their professional profile and may request reassignment
7. Confidentiality and HIPAA
We maintain appropriate safeguards for protected health information in accordance with HIPAA requirements. Business Associate Agreements are available for covered entities. Separate agreements govern the handling of protected health information in connection with evaluation services.
8. Intellectual Property
The Evalpals website, platform, and related materials are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9. Prohibited Uses
You agree not to:
- Use our services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our services
- Transmit malicious code or harmful content
- Misrepresent your identity or credentials
- Use our services to harass or harm others
10. Disclaimers
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE PROFESSIONAL JUDGMENTS OR OPINIONS EXPRESSED BY LCSWs IN THEIR EVALUATION REPORTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVALPALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Evalpals and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
13. Dispute Resolution
Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California. You waive any right to participate in a class action lawsuit.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
16. Termination
We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Provider (Clinician) Terms
Clinicians who join the Evalpals network are independent contractors, not employees. In addition to these Terms, clinicians are bound by a separate Provider Agreement and Business Associate Agreement executed during onboarding. Among other things, clinicians agree to:
- Maintain an active California LCSW license and current malpractice insurance
- Complete verification and onboarding before claiming any request
- Provide services within their professional scope and independent clinical judgment
- Receive payment through our third-party payment processor, which issues applicable tax forms (e.g., 1099-NEC)
- Keep all client information confidential and handle it in accordance with HIPAA and the Business Associate Agreement
19. Reviews and Ratings
Attorneys may review clinicians they have worked with. Reviews must be accurate and must not contain any client-identifying or protected health information. Evalpals may moderate, redact, or remove reviews that violate these Terms, contain protected health information, or are abusive or unlawful. Reviews reflect the views of the reviewer, not Evalpals.
